These Terms and Conditions ("Terms") govern the use of the website liberiludi.com (the "Site") and participation in the activities of Liberi Ludi AISBL ("Liberi Ludi", "we", "us"), an Association internationale sans but lucratif registered in Belgium under BCE number 1035455303, with registered office at Chaussée d'Ixelles 240, 1050 Ixelles, Belgium.

By using the Site, by submitting a profile to Creative Space, by submitting a project, by subscribing to the newsletter, or by making a donation, you accept these Terms. If you do not accept them, please do not use the Site or submit information to us.

These Terms are governed by Belgian law. The French-language version is the authoritative version in case of dispute.

Site — the website liberiludi.com and all subpages. Participant — any natural or legal person who submits a profile to Creative Space, a project to Liberi Ludi, or who otherwise enters into a non-financial relationship with Liberi Ludi. Donor — any natural or legal person who makes a financial donation to Liberi Ludi. Content — text, images, video, audio, files and personal data that you submit to the Site or to Liberi Ludi. Programme — any activity of Liberi Ludi, including grant applications, partner projects, methodological work, publications and events.

Creative Space is the open directory of artists, illustrators, animators, art educators and workshop facilitators hosted on liberiludi.com. The directory is open to view: any visitor of the Site can see participant profiles and contact the participant directly.

By submitting a profile to Creative Space, you confirm that:

(a) the information you submit is accurate, complete and current; (b) you hold the rights to all materials (text, images, samples of work, links to portfolio) you include in your profile; (c) you have obtained any consents needed from third parties shown or named in your profile (co-authors, children appearing in samples of work — note that images of children require special care and informed consent of legal guardians); (d) you are at least 18 years old, or, if you are a legal entity, you are duly authorised to bind the entity to these Terms.

The accuracy, completeness and currency of any personal data, professional information, samples of work, contact details and statements published in your Creative Space profile is your sole responsibility. Liberi Ludi acts only as a platform that makes your information available. Liberi Ludi does not verify and does not guarantee the accuracy of participant information, and is not liable for any consequences arising from inaccurate, incomplete or outdated information published in a participant profile.

By submitting documents and signing these Terms (or by ticking the consent box when submitting the form), you give Liberi Ludi your consent to present you to third-party organisations — funders, partner NGOs, schools, cultural institutions, public authorities — as a potential participant in grant programmes and partnership initiatives that, in Liberi Ludi's reasonable assessment, fit your profile.

This consent is limited to making your profile information available and proposing you for opportunities. It does not authorise Liberi Ludi to enter into commitments on your behalf.

Publication of your profile on liberiludi.com does not constitute a public offer (offre publique / openbaar aanbod) of any kind by Liberi Ludi. In particular:

(a) Liberi Ludi is under no obligation to grant any participant access to its grant database, opportunities, projects or programmes; (b) no participant is under any obligation to participate in any Liberi Ludi programme proposed to them; (c) the absence of an invitation, the absence of a proposal, or the absence of inclusion in a specific programme creates no entitlement and no liability for either side.

At any stage of the relationship, either Liberi Ludi or the participant may withdraw from a proposed collaboration without giving reasons and without any liability arising from the withdrawal as such. Reasonable notice should be given where work has already started.

Withdrawal from a specific proposal does not in itself remove a participant from Creative Space, and does not by itself end the wider relationship between the participant and Liberi Ludi.

A binding collaboration agreement between Liberi Ludi and a participant is concluded only when a specific grant, partnership or project is opened and a written agreement is signed by both parties. Until such an agreement is signed, no party owes any specific deliverable to the other.

By participating in Liberi Ludi activities involving children, Participants undertake to comply with applicable European and national standards for the protection of children's rights, including the UN Convention on the Rights of the Child, the Council of Europe Strategy for the Rights of the Child, the relevant provisions of Belgian law and equivalent provisions of the participant's country of activity.

In particular, Participants undertake to obtain informed consent of legal guardians before working with a child, to use age-appropriate practices, and not to publish images of children without explicit consent.

By submitting a profile or a project, the Participant declares that they have read and agree with the goals, mission, methodology and values of Liberi Ludi as set out on the Site (in particular on the pages /our-work, /methodology and /methodology/foundations).

You may modify or remove your profile at any time by writing to liberi@liberiludi.com. We will action the request within ten working days.

Liberi Ludi may, at its sole discretion and without giving reasons, decline to publish a profile, remove a published profile, or edit a published profile for compliance with these Terms. We will inform the participant of the action taken.

The rules of section 2 above apply, mutatis mutandis, to project submissions through the "Share your project" form. In particular:

• accuracy of project information is the submitter's responsibility (2.3);

• Liberi Ludi may, but is not obliged to, propose the project to partners or include it in grant work (2.4, 2.5);

• either side may step back without explanation at any stage (2.6);

• a binding agreement requires a written contract (2.7).

Liberi Ludi accepts donations from natural persons and from legal persons (companies, foundations, public institutions) in support of its statutory mission. Donations may be one-off or recurring.

Note: As of 2026-05-26, Liberi Ludi's bank account is in the process of being opened. Donation methods (bank transfer, online card payment, structured giving) will be published on the page /donate as soon as banking arrangements are confirmed. Until that page goes live, prospective donors are invited to contact us at liberi@liberiludi.com.

A donation, in any amount and from any source, does not give the donor any right of control over Liberi Ludi's strategy, governance, programmes or editorial choices. Liberi Ludi remains fully independent and accountable to its General Assembly and Board.

Liberi Ludi reserves the right, at its sole discretion and without giving reasons, to decline any donation, in particular where the donation appears to be inconsistent with the association's mission and values, where it would compromise the association's independence or reputation, where the source of funds is unclear or potentially unlawful, or where accepting the donation would create a conflict of interest with another donor or partner.

Liberi Ludi does not, as a matter of policy, accept donations from manufacturers of tobacco, weapons, gambling operators, or from entities under sanction by the European Union.

Liberi Ludi has initiated the procedure for obtaining the agrément fiscal under Article 145³³ of the Belgian Income Tax Code (CIR/WIB), which would allow Belgian-resident donors to deduct qualifying donations from their taxable income.

This procedure is in progress and not yet concluded. Until the agrément is granted, donations to Liberi Ludi are not eligible for the Belgian tax deduction and Liberi Ludi cannot issue official tax receipts (attestations fiscales). Donations remain welcome on a non-deductible basis. This page will be updated as soon as the agrément status changes.

A donor who has made a donation in error or who has changed their mind may request a refund by writing to liberi@liberiludi.com within thirty (30) days of the donation. We will refund the donation, less any non-recoverable transaction fees charged by the payment processor.

After this thirty-day window, refunds are at the sole discretion of Liberi Ludi and may not be possible if the donation has already been allocated to a specific programme.

Donors who wish to remain anonymous may indicate this at the moment of donation or by writing to liberi@liberiludi.com. Liberi Ludi will not publish the names of anonymous donors in its annual report or communications.

Liberi Ludi publishes an annual activity and financial report after each General Assembly. The report sets out total income, total expenditure, the use of funds by programme, and (with their consent) major institutional donors. Anonymous donors are not named.

You may use the Site for the purposes set out in these Terms. You agree not to:

• impersonate another person or entity, including by submitting false information in a profile or project;

• attempt to gain unauthorised access to any part of the Site, including by automated means (other than standard search-engine indexing);

• transmit malicious code, attempt to compromise the security of the Site, or interfere with its normal operation;

• use Site content (text, images, documents) in any manner inconsistent with applicable copyright and intellectual property law.

All content on the Site, except participant-submitted content and content explicitly marked as third-party, is the intellectual property of Liberi Ludi AISBL. Text on the Site is made available under a Creative Commons Attribution — Non-Commercial — Share-Alike licence (CC BY-NC-SA 4.0) unless explicitly marked otherwise. Logos, the "Liberi Ludi" name and the "Babiling" name are not covered by this licence and may not be used without prior written permission.

You retain all intellectual property rights in the content you submit (profile, project, samples of work). By submitting content, you grant Liberi Ludi a non-exclusive, royalty-free, worldwide licence to display the content on the Site, in the Liberi Ludi newsletter, in materials presented to potential partners and funders, and in our activity reports, for the duration of your participation and for a reasonable period thereafter.

This licence is limited to the purposes set out in these Terms. We will not commercialise your content. We will not sublicense it to third parties beyond the purposes set out above without your separate consent.

You may withdraw your content at any time by writing to liberi@liberiludi.com (see 2.10).

The Site and the information on it are provided "as is". Liberi Ludi makes no warranty that the Site will be uninterrupted, error-free, or fit for any particular purpose.

To the maximum extent permitted by Belgian law:

(a) Liberi Ludi is not liable for the accuracy of participant-submitted information (see 2.3);

(b) Liberi Ludi is not liable for actions of third parties who contact a participant via Creative Space;

(c) Liberi Ludi is not liable for indirect, incidental, consequential, or punitive damages arising from the use of the Site;

(d) Liberi Ludi's total liability under these Terms, to the extent permitted by law, is limited to the amount the relevant party has paid to Liberi Ludi in the twelve months preceding the event giving rise to the claim, or — if no payment has been made — to one hundred (100) euros. Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be limited under Belgian law.

Liberi Ludi processes personal data in accordance with the General Data Protection Regulation (Regulation (EU) 2016/679, RGPD) and the Belgian Data Protection Act of 30 July 2018. Details — including the lawful bases for processing, retention periods, the processors we use, and your rights — are set out in our Privacy Policy.

Liberi Ludi may update these Terms from time to time. The version in force is always the one published on this page, with the date of the latest update at the top. Material changes will be announced in the Liberi Ludi newsletter and, where appropriate, by direct email to active participants and donors. Continued use of the Site or participation in Liberi Ludi activities after a change constitutes acceptance of the updated Terms.

These Terms are governed by Belgian law.

The parties shall attempt to resolve any dispute amicably. Where amicable resolution is not possible, the courts of the judicial district of Brussels (French-speaking division) have exclusive jurisdiction, subject to the mandatory rules of consumer protection law that may apply to natural persons acting outside their trade or profession.
